1. Acceptance of Terms

By accessing or using Mockup Generator ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Mockup Generator provides:

• Wall art mockup generation for e-commerce listings (Etsy, etc.)
• Print-ready deliverable files for customer orders
• AI-powered image upscaling
• Template library with various room scenes

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription Plans & Billing

We offer free and paid subscription tiers:

• Free: Limited monthly usage with watermarks
• Basic ($9/mo): 50 deliverables, no watermarks
• Pro ($29/mo): Unlimited usage, API access
• Team ($79/mo): Team features, extended retention

Subscriptions are billed monthly. You may cancel at any time, and access continues until the end of your billing period. Refunds are provided at our discretion for technical issues.

5. Acceptable Use

You agree NOT to:

• Upload content you don't have rights to use
• Use the service for illegal purposes
• Attempt to reverse engineer or exploit the service
• Share account credentials with others
• Automate access beyond provided API limits
• Upload inappropriate, offensive, or illegal imagery

6. Intellectual Property

Your Content: You retain all rights to artwork you upload. We do not claim ownership of your designs.

Our Content: Mockup templates, room scenes, and the service itself are our property. You receive a license to use generated mockups for commercial purposes (e.g., Etsy listings).

Generated Output: Mockups you create using your artwork are yours to use commercially without attribution.

7. Usage Limits & Fair Use

Each tier has specific monthly limits. Cached deliverables have retention periods based on your tier:

• Free: 14-day retention
• Basic: 30-day retention
• Pro: 90-day retention
• Team: 1-year retention

After expiration, deliverables are automatically deleted. Download them before expiry.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with reasonable notice
• Modify or discontinue features
• Suspend accounts that violate these terms

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We are not liable for:

• Lost profits or business interruption
• Data loss (keep your own backups)
• Issues arising from third-party services (Stripe, etc.)

Our total liability is limited to the amount you paid us in the past 12 months.

10. Termination

You may cancel your account at any time. We may terminate accounts that violate these terms. Upon termination:

• Your access ends immediately
• Cached deliverables are deleted
• No refund for partial billing periods (unless required by law)

11. Changes to Terms

We may update these terms. Continued use after changes constitutes acceptance. We'll notify users of significant changes via email.
